1. About Geekify

Geekify is a Shopify-focused agency that provides ecommerce development, custom app development, store optimization, migration, integration, and ongoing Shopify support. We also develop and publish Shopify applications, including Geekify: Form to WhatsApp and Geekify: Upsell Progress Bar.

2. Acceptance of Terms

By accessing this website, submitting a contact or inquiry form, requesting a quote, purchasing or installing a Geekify app, or hiring us for development or consulting services, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

3. Website Use

You agree to use our website only for lawful purposes and in a way that does not infringe the rights of others or restrict their use of the site. You must not:

Specific project scope, deliverables, timelines, and fees will be defined in a separate proposal, statement of work, invoice, or written agreement. In the event of any conflict between these Terms and a signed project agreement, the signed project agreement will prevail for that specific engagement.

5. Shopify Apps

Our Shopify apps are provided through the Shopify App Store or related distribution channels and are subject to Shopify’s own terms and policies in addition to these Terms.

By installing or using a Geekify app, you agree that:

  • You are responsible for configuring the app correctly within your Shopify store
  • You will use the app in compliance with applicable laws and Shopify policies
  • You are responsible for the content, customer communications, and data processed through the app
  • We may update, modify, suspend, or discontinue app features to improve performance, security, or compliance

Some app features may require third-party services such as WhatsApp, payment providers, or analytics tools. Your use of those services is governed by their respective terms.

6. Client Responsibilities

If you hire Geekify for development, consulting, or support services, you agree to:

  • Provide accurate project requirements, content, credentials, and timely feedback
  • Ensure you have the legal right to use any materials, branding, or data you provide
  • Maintain secure access to your Shopify store, hosting, and third-party accounts
  • Review and approve deliverables within agreed timelines
  • Comply with Shopify’s terms of service and applicable ecommerce laws

Delays caused by incomplete information, late approvals, or third-party platform issues may affect delivery schedules and are not the sole responsibility of Geekify.

7. Fees and Payment

Fees for services, retainers, and custom development work will be communicated before work begins unless otherwise agreed in writing. Unless stated otherwise:

  • Invoices must be paid by the due date specified on the invoice or agreement
  • Late payments may delay project work or support
  • Deposits and milestone payments may be non-refundable once work has commenced
  • Third-party costs such as app subscriptions, themes, plugins, hosting, or licensing are your responsibility unless explicitly included in our proposal

8. Intellectual Property

Unless otherwise agreed in writing:

  • Geekify retains ownership of its pre-existing tools, frameworks, code libraries, designs, processes, and proprietary materials
  • Upon full payment, clients receive rights to the final deliverables created specifically for their project as defined in the project agreement
  • We may showcase completed work, screenshots, or case studies for marketing purposes unless a confidentiality agreement states otherwise
  • Our website content, branding, logos, and app names may not be copied, modified, or reused without written permission

9. Confidentiality

We treat client business information, store data, and project details as confidential and use them only to deliver agreed services. You agree not to disclose our proprietary methods, unpublished pricing, or internal processes without consent, except where required by law.

10. Third-Party Platforms and Integrations

Our services and apps often rely on third-party platforms such as Shopify, WhatsApp, payment gateways, analytics providers, and hosting services. Geekify is not responsible for outages, policy changes, pricing changes, or service interruptions caused by third-party providers.

11. Disclaimer of Warranties

Our website, apps, and services are provided on an “as is” and “as available” basis to the fullest extent permitted by law. While we strive to deliver high-quality Shopify solutions, we do not guarantee uninterrupted website access, specific revenue outcomes, error-free operation in every environment, or compatibility with all third-party tools or custom store setups.

12. Limitation of Liability

To the maximum extent permitted by law, Geekify and its team members shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or business opportunities arising from your use of our website, apps, or services.

Our total liability for any claim relating to our website, apps, or services shall not exceed the amount paid by you to Geekify for the specific service or app giving rise to the claim during the twelve (12) months preceding the event.

13. Indemnification

You agree to indemnify and hold harmless Geekify from claims, damages, losses, and expenses arising out of your misuse of our website or apps, your store content or customer communications, your violation of these Terms, or your infringement of any third-party rights.

14. Termination

We may suspend or terminate access to our website, apps, or services if you breach these Terms, fail to make required payments, or use our solutions in a way that creates legal, security, or platform risk. You may stop using our website or uninstall our apps at any time, subject to any active service agreement or billing obligations.
